The Failure of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the introduction of a new 28-article proposal for ending the war appeared – temporarily – to have been stabilised. A American diplomat spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Peace Talks and Military Action

The chain of conflicting incidents captured the harsh reality of the recent timeframe. By day, negotiation efforts are conducted: optimistic declarations are released from multiple capitals. Considerable effort is expended on containing particular approaches. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "settlement".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is equipped to monitor rocket firings from across the border, a ability afforded by up-to-date information. From observation points, Ukrainian air force fighter jets that had been scrambled to counter approaching guided weapons flew past – advanced fighter aircraft provided to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons activated: defensive missiles deployed against a Russian ballistic missile. This was a modern interception technology at work, most likely delivered by allied countries. Every launch jolts you unexpectedly, shaking the windows. The instant of fear quickly becomes grim resignation: perhaps the approaching threat won't hit its mark this time, protecting urban areas from devastation and another blackout.

Continuous Dangers

Following this, a large-caliber weapon engaged a aerial vehicle somewhere nearby, part of a mobile-fire group – almost certainly allied-provided weaponry. Unfortunately, the shots failed to hit the hostile drone – it continued its flight toward its objective.

Intermittently, this persisted until dawn. Kyiv awoke to the morning news: multiple fatalities, damage and utility failures in multiple buildings as a result of the night's assault. As always, everyone still continued their routines – living the war. But those 24 hours encapsulated Ukraine's essential dependence on Western support – a dependence that European nations are clearly incapable to fill in the immediate future.

Ineffective Peace Efforts

The 28-point plan from US administration provoked deep reactions, controversy and profound anxiety – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new approach from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They manage the tension but never actually win the battle. This cycle will, undoubtedly, endure.

Tactical Assessments

It is convenient to criticize certain parties of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. US administration operates on a principle well known to international relations experts: you cannot win at the negotiating table what you have failed to defend militarily. The White House believes that it is unfeasible to force Russia to surrender the land that it already controls in Ukraine's south or east.

The issue is that while recognising this factual reality, US leadership does little to deter Moscow, through statements or actions, from believing that the status quo will not evolve additionally in its favour in the near future.

Divergent Views

Therefore, Moscow is convinced that time is on his side – that Ukraine and its partners are coming close to fatigue. Their motivation to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to achieve ceasefire, but they will continue as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing people and territory but avoiding a total frontline collapse until situations evolve in its favour.

Existing Situation

Objectively, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: leadership ambitions to negotiate peace and secure international recognition, and Kyiv's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any proposal Kyiv finds unsuitable, so that their focus does not shift toward domestic problems. And although their mission will now be much harder after recent developments, it remains very improbable that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Conclusion and Outlook

It took a only one week to eliminate the 28 points of the latest plan. Aggressive and erratic handling of the matter by US administration, resistance by Ukraine and the other European countries, along with soothing efforts of diplomats, and finally, latest revelations, all achieved their purpose.

While new proposals based on old ideas are approaching, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are founded on Moscow's terms and show particular unwillingness to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the predictable period, primarily depend on sustained allied backing.
